In a Monday post-conviction hearing, convicted death row inmate Marlon Kiser said he wants a new attorney. He was convicted in November 2003 for the murder of Hamilton County Deputy Sheriff Donald Bond. His current attorney, Rick Haberman, asked the judge that a competency evaluation be done. It was in attempt to prove that Kiser couldn't make his own decisions, like firing an attorney.Poole granted an evaluation, and Kiser is due back in his courtroom September 24th.If Kiser is found to be competent, he will be granted a new attorney and another murder trial could be possible.
